Legal terms and conditions for using our platform

By accessing or using Funscripted ("funscripted.com"), operated by Bliss Online Entertainment Inc. (Business Number: 761487628), a corporation registered in Ontario, Canada, you agree to be bound by these Terms of Service.
1. Acceptance of Terms
By creating an account, accessing, or using Funscripted (the "Platform"), operated by Bliss Online Entertainment Inc. (Business Number: 761487628), a corporation registered in Ontario, Canada, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
These Terms apply to all users, including browsers, vendors, customers, merchants, and contributors of content.
2. Platform Description
Funscripted is an online platform that facilitates the buying, selling, and sharing of interactive adult entertainment scripts ("Scripts"). The Platform allows users to:
- Upload and sell Scripts
- Purchase Scripts from other users
- Rate and review Scripts and users
- Create collections and libraries
- Interact with the community
3. Script Ownership and Purchase Rights
3.1 Buyer Rights
- Upon purchase completion, the buyer obtains permanent, irrevocable ownership rights to the purchased Script.
- The buyer retains full rights to their purchased copy even if the seller removes the Script from the Platform.
- The buyer may download, store, backup, and use their purchased Scripts indefinitely.
- The buyer may not redistribute, resell, or commercially exploit the Script without explicit seller permission.
- The buyer may use the Script for personal entertainment purposes as intended.
3.2 Seller Obligations
By listing a Script for sale, sellers agree:
- Upon sale completion, the buyer obtains permanent ownership rights to their copy.
- Sellers cannot revoke buyer access to purchased Scripts, even after deletion from the Platform.
- Sellers retain copyright and intellectual property rights to their original work.
- Sellers grant buyers a permanent, non-transferable license for personal use.
- Sellers must ensure they have full rights to sell the Script and that it contains no copyrighted material without permission.
3.3 Script Authenticity and Content
- Sellers warrant that uploaded Scripts are their original work or they have proper licensing rights.
- Scripts must not contain copyrighted audio, video, or other material without proper authorization.
- All participants in any referenced content must be of legal age and have provided proper consent.
- Scripts must comply with applicable laws in the seller's and buyers' jurisdictions.
4. Intellectual Property and Copyright
4.1 Platform Rights
Funscripted reserves the right to remove content or take action in the following circumstances:
- Remove any Script that violates copyright laws, intellectual property rights, or receives a valid DMCA takedown notice.
- Remove content that violates these Terms, community guidelines, or applicable laws. Changes to community guidelines that affect Script acceptance criteria will be communicated to sellers at least 30 days before taking effect, giving sellers time to update or remove affected content
- Suspend or terminate user accounts for repeated or severe violations.
- Cooperate with copyright holders and law enforcement regarding infringement claims.
- Preserve evidence of potential legal violations.
- Sellers will be notified of content removal and the reason, except where prohibited by law or law enforcement request. Sellers may appeal content removal decisions through [email protected].
4.2 DMCA Compliance
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). To report copyright infringement:

Include: Identification of copyrighted work, location of infringing material, contact information, good faith statement, and electronic signature.
4.3 DMCA Counter-Notification
If your content was removed due to a DMCA takedown notice and you believe it was removed in error, you may submit a counter-notification to [email protected] containing:
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to the jurisdiction of the federal courts in Ontario, Canada
- Your physical or electronic signature
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content at our sole discretion. Funscripted is not liable for any damages resulting from the removal or restoration of content pursuant to the DMCA process. Filing a false counter-notification may result in legal liability and account termination.
5. User Conduct and Prohibited Activities
5.1 Acceptable Use
Users must:
- Provide accurate account information
- Respect other users and maintain civil discourse
- Use the Platform only for its intended purposes
- Comply with all applicable laws and regulations
- Respect age restrictions and content warnings
5.2 Prohibited Activities
Users may NOT:
- Upload, distribute, or access child sexual exploitation material (CSEM) or any content involving minors - ZERO TOLERANCE
- Upload content involving anyone under 18 years of age in sexual or suggestive contexts
- Upload illegal, harmful, or non-consensual content
- Infringe on intellectual property rights
- Harass, threaten, or abuse other users
- Attempt to bypass payment systems or engage in fraud
- Distribute malware or engage in hacking attempts
- Create fake accounts or manipulate ratings
- Share purchased Scripts without authorization
- Reverse engineer or attempt to extract proprietary algorithms
- Use the Platform for commercial spam or solicitation
- Upload content depicting violence, coercion, revenge, or non-consensual activities
6. Payment Terms and Transactions
6.1 Pricing and Payment
- All prices are listed in USD unless otherwise specified
- Payments are processed through Stripe and other secure third-party providers. We are not responsible for any errors, failures, delays, or data breaches caused by third-party payment processors. Your use of payment services is subject to the respective third party's terms of service and privacy policy
- Sellers set their own prices subject to Platform guidelines
- Platform fees are deducted from seller earnings as disclosed. Fee percentages and structures are subject to change with a minimum of 30 days written notice to affected sellers via email
- All purchases are final upon successful payment processing. Limited refund eligibility applies only as described in Section 6.2
6.2 Refunds and Disputes
All Scripts include a visual preview (waveform image) prior to purchase. Buyers are expected to review the preview before completing their purchase. By completing a purchase, buyers confirm they have reviewed the available preview and accept the Script as presented.
- Refunds are only available in the following circumstances:
- Verified technical failure preventing download of a purchased Script
- A purchased Script file was not delivered or is missing from the buyer's library
- A duplicate purchase of the same Script (charged twice for one item)
- Refunds are NOT available for:
- Dissatisfaction with Script quality, style, or personal preference
- Claims that a Script does not function as expected with specific hardware or software
- Compatibility issues with third-party devices or applications
- Scripts that have already been downloaded and used
- Refund requests must be submitted within 7 days of purchase by contacting [email protected]
- The seller will be notified of refund requests. Funscripted retains final decision authority on all refund matters
- Content quality disputes should be resolved through the Platform's rating and review system. Sellers may report reviews they believe to be false, defamatory, retaliatory, or in violation of community guidelines by contacting [email protected]. Reported reviews will be investigated and may be removed at Funscripted's sole discretion
- Fraudulent transactions will be investigated and may result in account suspension
- Chargebacks may result in account restrictions for the buyer pending resolution. Buyers who initiate chargebacks for purchases that do not meet the refund criteria above may have their accounts permanently suspended
6.3 Seller Payouts
- Sellers may request payouts on demand once their available balance meets the minimum payout threshold. Earnings are subject to a hold period before becoming available for payout
- Minimum payout thresholds apply as published in the seller dashboard
- Tax reporting responsibilities belong to individual sellers
- The Platform may hold payouts for up to 30 days for investigation of potential violations. Sellers will be notified in writing of any payout hold, the reason for the hold, and the expected resolution timeframe. If no violation is confirmed within 30 days, held funds will be released
7. Age Verification and Adult Content
This is an adults-only platform.
- Users must be 18 years or older to access the Platform
- All content is intended for adult audiences only
- Users affirm they are of legal age in their jurisdiction to access adult content
- Parents/guardians are responsible for restricting minors' access
- Age verification may be required for certain transactions or content
7.1 Zero Tolerance: Child Exploitation Material
Child pornography and any form of child sexual exploitation material (CSEM) is strictly prohibited and illegal.
- ANY content involving minors (under 18 years of age) in sexual or suggestive contexts is absolutely forbidden.
- Suspected child exploitation material will be immediately reported to the National Center for Missing & Exploited Children (NCMEC), FBI, and appropriate law enforcement agencies.
- User information, IP addresses, and all relevant data will be provided to law enforcement without exception.
- Accounts uploading such material will be permanently banned and prosecuted to the full extent of the law.
- We maintain zero tolerance and will cooperate fully with all law enforcement investigations.
7.2 Content Standards
- All referenced performers in any content must be verified adults (18+ years old)
- Documentation proving age verification may be required for content creators
- Non-consensual content is strictly prohibited
- Content must comply with applicable obscenity laws
- Extreme or illegal content categories are prohibited
- Content depicting violence, coercion, or harm is forbidden
- All content must feature consenting adults only

- All reports are treated with utmost priority and confidentiality
8. Privacy and Data Protection
Your privacy is important to us. Our data collection and usage practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.
- We collect minimal personal information necessary for Platform operation
- Payment information is processed by secure third-party providers
- User activity data helps improve Platform functionality
- Data may be shared with law enforcement if legally required
- Users may request data deletion subject to legal and operational requirements
9. Platform Availability and Technical Issues
9.1 Service Availability
- We strive to maintain Platform availability but cannot guarantee 100% uptime
- Scheduled maintenance will be announced when possible
- Emergency maintenance may occur without advance notice
- Users are responsible for backing up their purchased content
9.2 Technical Support
- Technical support is provided on a best-effort basis
- Users should report technical issues through official support channels
- Platform compatibility requirements are listed in our documentation
- Third-party software integration issues are outside our support scope
10. Account Termination and Suspension
10.1 Termination Rights
Funscripted may terminate or suspend accounts for:
- Immediate permanent ban: Child sexual exploitation material (CSEM) or any content involving minors
- Immediate ban: Non-consensual, violent, or illegal content
- Violation of these Terms of Service
- Intellectual property infringement
- Fraudulent activity or payment disputes
- Uploading illegal or harmful content
- Harassment or abuse of other users
- Multiple community guideline violations
- Attempting to circumvent age verification systems
10.2 Effect of Termination
- Terminated users lose access to their account and uploaded content
- Upon account termination, all Scripts belonging to the terminated seller will be permanently removed from the Platform and will no longer be available for new purchases. The Platform will not continue to sell, distribute, or profit from a terminated seller's content
- Buyers who purchased Scripts prior to the seller's termination retain permanent access to their purchased copies as per the buyer ownership rights in Section 3.1
- For non-CSEM and non-illegal-content terminations, outstanding earned payouts will be processed within 60 days of termination, minus any amounts owed to the Platform for chargebacks, refunds, or fees. Funscripted reserves the right to withhold payouts where there is reasonable evidence of fraud, Terms violations, or pending disputes
- For terminations involving illegal content or CSEM, all payouts are permanently forfeited
- Users may appeal termination through [email protected] within 30 days of the termination notice. Appeals will be reviewed within 15 business days. Funscripted's decision on appeals is final
- Circumventing suspensions through new accounts is prohibited and may result in forfeiture of all pending payouts
10.3 Account Closure and Data Export
- Sellers may voluntarily close their account at any time by contacting [email protected]
- Upon voluntary account closure, sellers may request an export of their own sales transaction history and earnings data. Export requests will be fulfilled within 30 days
- Exported data is limited to the seller's own transaction records. Buyer personal information, reviews, and Platform proprietary data (such as algorithms, analytics, or aggregated marketplace data) are not included in exports and remain the property of Funscripted
- After account closure, previously sold Scripts will remain accessible to buyers who purchased them, as per the permanent buyer ownership rights in Section 3.1
- Final payouts for voluntarily closed accounts will be processed within 30 days, subject to the minimum payout threshold and any outstanding obligations
11. Disclaimers and Limitation of Liability
11.1 Marketplace Facilitator Only
- Funscripted operates solely as a marketplace facilitator. We provide the technology platform that enables users to buy and sell Scripts. We are not a party to any transaction between buyers and sellers.
- We do not create, curate, endorse, verify, or guarantee any user-generated content, including Scripts, reviews, ratings, profiles, or any other user submissions.
- All content on the Platform is created and uploaded by independent users. User-generated content represents the views, opinions, and work of individual users and does not reflect the views or endorsement of Funscripted.
- We are not responsible for the quality, accuracy, legality, safety, or appropriateness of any Script or content uploaded by users.
- We bear no responsibility for any disputes, disagreements, or issues arising between buyers and sellers. Users transact at their own risk.
11.2 Service Disclaimer
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
- We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components
- We do not guarantee Script quality, accuracy, compatibility, functionality, or fitness for any purpose
- We make no representations regarding the reliability, timeliness, or accuracy of any content, information, or services provided through the Platform
- Third-party services and integrations (including but not limited to Stripe, payment processors, and authentication providers) are provided without warranty and we bear no responsibility for their operation, availability, or data handling
- Platform availability and performance may vary and are not guaranteed
11.3 No Guarantee of Earnings
- We make no guarantees regarding sales volume, revenue, earnings, or income for sellers. Any earnings projections, calculators, or examples shown on the Platform are for illustrative purposes only and do not constitute a promise or guarantee of any earnings.
- Sellers are solely responsible for the commercial success or failure of their Scripts
- Platform fees, payout schedules, and payment terms are subject to change with a minimum of 30 days written notice to sellers via email. Continued use of the Platform after such notice constitutes acceptance of the updated terms
11.4 Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Funscripted, its owners, operators, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages
- We are not liable for any loss, damage, or harm arising from: user-generated content, transactions between users, unauthorized access to your account, any bugs or errors in the Platform, or any interruption or cessation of service
- Force majeure events (including but not limited to natural disasters, acts of government, internet failures, cyberattacks, and pandemics) excuse Platform performance obligations
11.5 Indemnification
You agree to indemnify, defend, and hold harmless Funscripted, its owners, operators, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Platform or violation of these Terms
- Any content you upload, publish, or distribute through the Platform
- Any transaction you enter into with another user
- Your violation of any law, regulation, or third-party rights (including intellectual property rights)
- Any claim by a third party related to your content or activities on the Platform
Funscripted will make reasonable efforts to promptly notify users of any third-party claims that may trigger indemnification obligations, and will provide the user with relevant claim details to the extent permitted by law. Funscripted retains sole discretion over its response to any claims and is not obligated to accept any settlement proposed by the indemnifying user.
12. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles
- Disputes should first be addressed through Platform support channels at [email protected]. You agree to attempt informal resolution for a period of at least 30 days before initiating any legal proceeding
- Any disputes arising under or in connection with these Terms that cannot be resolved informally shall be submitted to binding arbitration administered in Ontario, Canada, and you waive any right to a jury trial
- To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. You waive any right to participate in class action lawsuits or class-wide arbitration
- Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction for intellectual property violations or to prevent irreparable harm
13. Assumption of Risk
- You acknowledge and agree that your use of the Platform is entirely at your own risk. You are solely responsible for evaluating the suitability, quality, and legality of any content you access, purchase, or download through the Platform.
- You understand that the Platform hosts user-generated content and that we have no obligation to pre-screen, monitor, review, or verify any content before or after it is uploaded
- You are solely responsible for any damage to your computer, devices, or data that may result from downloading or using any content from the Platform
- You acknowledge that interacting with other users and entering into transactions carries inherent risks, and you assume all such risks
- Sellers assume all risk associated with offering content for sale, including but not limited to liability for intellectual property claims, content disputes, and tax obligations. However, the Platform will provide reasonable cooperation to sellers in responding to third-party claims related to content sold through the Platform, such as forwarding relevant notices and providing access to transaction records pertaining to the seller's own content, to the extent permitted by law and at the Platform's sole discretion
14. Hardware and Physical Product Sales
In addition to digital Scripts, Funscripted may offer physical hardware products for sale ("Hardware Products"). The following terms apply specifically to Hardware Product purchases and supplement the general terms above.
14.1 Orders and Payment
- All Hardware Product prices are listed in EUR unless otherwise specified. If your payment method is denominated in a different currency, the final amount charged will be converted by your payment provider at their prevailing exchange rate. We are not responsible for exchange rate fluctuations or conversion fees applied by your bank or payment provider
- Payments for Hardware Products are processed through Stripe. By completing a purchase, you agree to Stripe's terms of service
- All Hardware Product orders are made-to-order. Production begins upon payment confirmation. Estimated delivery times are provided at the time of purchase but are not guaranteed
- We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear to be placed by resellers, dealers, or distributors
- Import taxes, customs duties, and any other fees imposed by the destination country are the sole responsibility of the buyer. These charges are not included in the product price or shipping cost and will be collected upon delivery by your local customs authority
14.2 Shipping and Delivery
- Hardware Products ship from Europe. Shipping costs are calculated at checkout
- Delivery times vary by destination and are estimates only. We are not liable for delays caused by shipping carriers, customs processing, weather, or other circumstances beyond our control
- Risk of loss and title for Hardware Products pass to you upon delivery to the shipping carrier. We are not responsible for packages lost, stolen, or damaged in transit. We recommend purchasing shipping insurance where available
- It is your responsibility to provide accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the buyer. Re-shipping costs for address errors are the buyer's responsibility
14.3 No Returns Policy
- All Hardware Product sales are final. We do not accept returns or offer refunds except in the limited circumstances described below.
- Due to the intimate nature of our Hardware Products, we cannot accept returns for hygiene and safety reasons. Once a product has been delivered, it cannot be returned for a refund regardless of whether it has been used
- Refunds or replacements are available only if:
- The product received is materially different from what was described on the product page
- The product arrives with a verified manufacturing defect that prevents normal operation
- The product was damaged during shipping and damage is documented upon receipt with photographic evidence
- Claims for defective, damaged, or incorrect products must be submitted within 14 days of delivery by contacting [email protected] with your order number, detailed description of the issue, and photographic evidence
- We reserve sole discretion in determining whether a product qualifies for replacement or refund. Our assessment is final
- Refunds are NOT available for:
- Change of mind, buyer's remorse, or personal preference
- Incompatibility with third-party software, devices, or operating systems
- Normal wear and tear or cosmetic imperfections inherent to the manufacturing process (e.g., minor surface variations in 3D-printed products)
- Damage caused by misuse, improper handling, unauthorized modification, or failure to follow care instructions
- Products where the buyer has failed to report the issue within the 14-day claim period
14.4 Limited Warranty
- Hardware Products are warranted against manufacturing defects for a period of 30 days from the date of delivery. This warranty covers defects in materials and workmanship under normal use conditions only
- This warranty does NOT cover: damage from misuse, abuse, neglect, unauthorized repair or modification, exposure to liquids beyond normal intended use, failure to follow product guidelines, normal battery degradation, or cosmetic wear
- If a valid warranty claim is confirmed, we will, at our sole discretion, either repair the product, provide replacement parts, replace the product, or issue a partial or full refund
- EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, ALL HARDWARE PRODUCTS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- We make no warranty regarding product lifespan, durability beyond the warranty period, or suitability for any specific use case
14.5 Limitation of Liability for Hardware Products
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total liability for any claim arising from or related to a Hardware Product purchase shall not exceed the purchase price paid for the specific product giving rise to the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use any Hardware Product, including but not limited to personal injury, property damage, or loss of data
- You acknowledge that Hardware Products are electronic devices used at your own risk. You are solely responsible for using products safely and in accordance with any provided instructions or guidelines
- We are not liable for any health effects, allergic reactions, or physical harm resulting from the use of our Hardware Products. If you have concerns about material sensitivities, consult a medical professional before use
14.6 Product Specifications and Availability
- Product descriptions, specifications, images, and pricing are subject to change without notice. We make reasonable efforts to ensure accuracy but do not guarantee that product descriptions are error-free
- Minor variations in color, dimensions, and finish between the product page and the delivered product are normal for handcrafted and 3D-printed items and do not constitute a defect
- Product availability is not guaranteed. We reserve the right to discontinue any product at any time without prior notice
- Firmware and software features described on product pages reflect capabilities at the time of listing. Future firmware updates may add, modify, or remove features. We are not obligated to maintain or update firmware indefinitely
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be announced through:
- Email notification to registered users at least 30 days before changes take effect
- Prominent notice on the Platform
- Updated "Last Modified" date
Continued use of the Platform after the 30-day notice period constitutes acceptance of the updated Terms.
If you do not agree with material changes, you may close your account and request final payout of any earned balance before the new Terms take effect. Funscripted reserves the right to make non-material changes (such as corrections, formatting, or clarifications) at any time without advance notice.

17. User Acknowledgment
By using Funscripted, you acknowledge and agree that:
- You have read and understood these Terms of Service in their entirety
- You are of legal age to access adult content in your jurisdiction
- You agree to the permanent ownership rights granted to buyers upon purchase
- You understand Platform rights regarding content removal and account termination
- You accept all risks and responsibilities of participating in this marketplace
- You understand that Funscripted acts solely as a marketplace facilitator and bears no responsibility for user-generated content, transactions between users, or any disputes arising therefrom
- You agree to the indemnification, limitation of liability, and assumption of risk provisions set forth in these Terms
- You waive any claims against Funscripted for damages arising from your use of the Platform, to the maximum extent permitted by law
